GENERAL ₊˚⊹♡
♡ please read before submitting a request! by commissioning me, you agree to everything listed below. if you don't understand something in my terms and need further clarification please reach out with questions BEFORE commissioning me.
♡ i have the right to decline a commission request if i feel my skills aren't up to par with what's being asked of me, or if the content doesn't align with my personal beliefs.
♡ all reference photos and a clear description of what you'd like must be provided prior to purchasing the commission. any features you'd like added on after i have started your commission may be subject to an additional fee.
♡ by commissioning me, you give me permission to use the work i made for you in my portfolio (including posting on social media) once it's finished. if you're not comfortable with this, please check the privacy box on the order form.
♡ i have not, nor will i ever use, AI or any machine learning tool to complete my artwork for you. i would appreciate if the references you provide to me are true to life and not AI generated, however i understand genuine confusion and indiscernibility of some AI artworks.
COMMUNICATION & PROCESS ₊˚⊹♡
♡ all communication will be through the platform of your commission request. please make sure you're available to respond to any updates or questions i have for you! if it gets hard to reach you as the deadline approaches and i need to move on to the next step, i will; despite any potential revision requests. any revision requests after this point that may delay the commission will be your responsibility.
♡ if you have a strict deadline, please let me know prior to purchasing the commission. otherwise, please allow me up to 1 month to complete your commission. this is subject to change based on complexity of the project.
♡ i will not directly copy or recreate another artist's work for your commission. if you provide a reference from another artist, please note that i will only use it to get a general idea of what you're looking for and will not copy it.
♡ this does not apply to references of vtuber models, however please make sure you respect
the TOS of your model mama/papa!♡ i'll be sending you updates as i make progress so you're always in the loop and can request changes easier! when the commission is finished, i'll send it through dms for one last final approval before uploading the full files.
♡ unless i made a mistake that neither of us caught, no further revisions are allowed after the files are uploaded. if in the future you would like small updates to the artwork (i.e color changes, new details, changed details) i will be happy to do so for an extra fee, however larger updates (i.e new background, major model changes) may need a separate new commission request.
PAYMENTS & PAYMENT PLANS ₊˚⊹♡
♡ payment plans are okay for all commission types! please select the option to discuss payment plans in the request form or message me to discuss the time frame you need in order for us to figure out a plan that works best for you!
please note: final files will be only delivered after all payments are completed♡ chargebacks are not tolerated under any circumstances. in the event that you charge back your payment, you will be blacklisted as a client.
REFUNDS & REVISIONS ₊˚⊹♡
♡ if you'd like a refund on your commission before i start, i will grant the full refund minus transaction fees.
♡ no refund will be given after i have moved on from approved sketches. if we are in the sketching phase and it seems i am not the right fit for you, an 80% refund will be issued (minus fees)
♡ i have the right to cancel if i'm uncomfortable with the commission or working with you. if that happens, you'll get a partial refund based on how much work is left minus fees. (ex: if 50% is done, you'll get 50% back minus fees.)
♡ if i miss the deadline or i am forced to deliver the files by moving onto the next step due to no communication or last minute changes from you, no refund will be issued.♡ unlimited revisions during the sketching phase
♡ limit of 5 revisions after the approved sketch is complete. after that it's $5 per extra revision. if i made a mistake (i.e wrong color, missing detail, etc.), the fee won't apply.
♡ please do not make any last minute revision requests unless absolutely necessary. if i have missed something previously discussed i will take full responsibility and honor the revision, however any new revision requests may not be honored due to time constraints.
CONTENT RESTRICTIONS & AI USAGE ₊˚⊹♡
♡ as an artist, i have limits skill wise and preferences of my own. if you request something i'm not personably comfortable with, i will let you know and decline your commission request. to save us both time, here is a list of things i definitely will not draw:
♡ furries/anthromorphs *
♡ mechs
♡ explicit adult content
♡ underaged characters
♡ political art (in any way, shape, or form)
*i do get commissioned for chibified animals (sometimes wearing clothes) and i am comfortable with this. to clarify, i have practically no skillset in drawing in the furry style or drawing fully anthromorphic characters.♡ any and all usage of AI tools to modify my artwork is strictly prohibited. this includes but is not limited to; AI platforms/programs, machine learning tools, NFTS, blockchain, or other for-profit platforms/purposes.
♡ it is strictly prohibited to feed my artwork into any AI program to generate animated versions/videos of the work.
♡ i will never use AI to create any pieces of artwork for you, and i expect the same level of respect when you use the work you have received from me.
PERSONAL/COMMERCIAL USE & INTELLECTUAL PROPERTY RIGHTS ₊˚⊹♡
♡ clients receive exclusive, non-transferable usage rights to the work for personal use.
♡ personal use means: display on social media accounts for promotional purposes with no
direct monetization such as profile pictures, banners, and posts; print and framing in personal
spaces; display as part of designs on websites and channels, excluding use in content of
these websites or channels.
♡ do not resell, redistribute, or claim any of my works to be your own.
♡ please credit me when using my work on social media or otherwise with either my twitter handle (@binksandbonks) or my vgen username/link.
♡ commercial usage rights are included on all services for the purpose of streaming and monitized content (such as youtube videos, tiktok or other platform short form content).
♡ an additional fee is required for commercial rights to the design for the purpose of merch and other instances where the design will be sold.♡ i retain copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. twitch) and more.
